THE ORDERS AND MEDALS OF THE SOCIALIST REPUBLIC OF VIETNAM

PHÁP LỆNH

ĐẶT HUÂN CHƯƠNG VÀ HUY CHƯƠNG CHIẾN SĨ VẺ VANG

Căn cứ vào điều 53 của Hiến pháp nước Việt Nam dân chủ cộng hoà;

Để phát huy tinh thần thi đua yêu nước của cán bộ và chiến sĩ trong việc xây dựng Quân đội nhân dân và Công an nhân dân vũ trang, nhằm bảo vệ sự nghiệp xây dựng chủ nghĩa xã hội ở miền Bắc, làm cơ sở vững chắc cho cuộc đấu tranh thực hiện hoà bình thống nhất nước nhà;

Uỷ ban thường vụ Quốc hội nước Việt Nam dân chủ cộng hoà đặt ra huân chương và huy chương Chiến sĩ vẻ vang và quy định việc tặng thưởng như sau:

Điều 1

Huân chương và huy chương Chiến sĩ vẻ vang tặng thưởng cho những cán bộ và chiến sĩ có công lao trong việc xây dựng Quân đội nhân dân và Công an nhân dân vũ trang sau ngày hoà bình lập lại (20 tháng 7 năm 1954).

Điều 2

Huân chương Chiến sĩ vẻ vang có ba hạng: hạng nhất, hạng nhì và hạng ba.

Huy chương Chiến sĩ vẻ vang chỉ có một hạng.

Điều 3

Huân chương và huy chương Chiến sĩ vẻ vang thưởng cho những cán bộ và chiến sĩ có đủ những điều kiện như sau:

1. Sau ngày 20 tháng 7 năm 1954 đã phục vụ tại ngũ liên tục trong thời gian nói ở điều 4 dưới đây:

2. Đã tích cực công tác và học tập, hoàn thành tốt nhiệm vụ trong thời gian tại ngũ.

3. Trung thành với cách mạng và không phạm sai lầm lớn trong thời gian tại ngũ cũng như sau khi đã xuất ngũ.

Điều 4

Những cán bộ và chiến sĩ đủ các điều kiện nói ở điều 3 thì được tặng thưởng huân chương hoặc huy chương theo tiêu chuẩn thời gian phục vụ như sau:

a) Huân chương Chiến sĩ vẻ vang hạng nhất thưởng cho những người đã phục vụ tại ngũ liên tục trong 15 năm.

b) Huân chương Chiến sĩ vẻ vang hạng nhì thưởng cho những người đã phục vụ tại ngũ liên tục trong 10 năm.

c) Huân chương Chiến sĩ vẻ vang hạng ba thưởng cho những người đã phục vụ tại ngũ liên tục trong 5 năm hoặc đã phục vụ tại ngũ liên tục từ 3 đến 4 năm mà được xếp vào loại giỏi về mọi mặt trong thời gian ấy.

d) Huy chương chiến sĩ vẻ vang thưởng cho những người đã phục vụ tại ngũ liên tục trong 3 năm hoặc đã phục vụ tại ngũ liên tục trong 2 năm mà được xếp vào loại giỏi về mọi mặt trong thời gian ấy.

Điều 5

Những cán bộ và chiến sĩ đã từ trần thì được truy tặng huân chương hoặc huy chương theo những quy định của điều 3 và điều 4 trên đây.

Điều 6

Đối với những liệt sĩ đã hy sinh trong chiến đấu hoặc trong công tác, việc truy tặng quy định như sau:

a) Những người đủ điều kiện được thưởng huân chương hạng nhì thì được truy tặng huân chương hạng nhất.

b) Những người đủ điều kiện được thưởng huân chương hạng ba thì được truy tặng huân chương hạng nhì.

c) Những người đủ điều kiện được thưởng huy chương thì được truy tặng huân chương hạng ba.

d) Những người đã phục vụ tại ngũ liên tục trong 2 năm hoặc đã phục vụ tại ngũ liên tục dưới 2 năm nhưng được xếp vào loại giỏi về mọi mặt trong thời gian phục vụ thì cũng được truy tặng huy chương.

Điều 7

Việc tặng thưởng huân chương Chiến sĩ vẻ vang do Uỷ ban thường vụ Quốc hội quyết định.

Việc tặng thưởng huy chương Chiến sĩ vẻ vang do Hội đồng Chính phủ quyết định.

Điều 8

Hội đồng Chính phủ quy định chi tiết thi hành pháp lệnh này.

Pháp lệnh này đã được Uỷ ban thường vụ Quốc hội nước Việt Nam dân chủ cộng hoà thông qua ngày 12 tháng 9 năm 1961.

ORDER

THE ORDER AND DECORATION OF THE SOLDIER OF GLORY

Pursuant to Article 53 of the Constitution of the Democratic Republic of Vietnam;

In order to promote the patriotic emulation spirit of cadres and soldiers in building the People's Army and the People's Armed Police, in order to protect the cause of building socialism in the North, as a solid basis for sure the struggle to realize the peace and unification of the country;

The Standing Committee of the National Assembly of the Democratic Republic of Vietnam set up the Order and Decoration of the Soldier of Glory and stipulates the award as follows:

Article 1

The Order and Decoration of the Soldier of Glory is awarded to officials and soldiers who have contributed to the construction of the People's Army and the People's Armed Police after the day of peace was restored (July 20, 1954).

Article 2

The Order of the Soldier of Glory has three grades: first, second and third.

The Decoration of the Soldier of Glory has only one grade.

Article 3

The Order and Decoration of the Soldier of Glory are awarded to cadres and soldiers who meet the following conditions:

1. After July 20, 1954 has continuous active service in time referred to in Article 4 below:

2. Has been actively working and studying, successfully fulfilling their duties during active service.

3. Is loyal to the revolution and didn't make major mistakes during their time in the army as well as after being discharged from the army.

Article 4

Officers and soldiers who meet the conditions mentioned in Article 3 are awarded orders or decorations according to the standard of service time as follows:

a) The first-class Order of the Soldier of Glory is awarded to those who have served in the army continuously for 15 years.

b) The second-class Order of the Soldier of Glory for those who have served in the army continuously for 10 years.

c) The third-class Order of the Soldier of Glory for those who have served in the army for 5 consecutive years or have served in the army for 3 to 4 years and are classified as excellent in all aspects during that time.

d) The Decoration of the Soldier of Glory for those who have served in the army continuously for 3 years or have served in the army continuously for 2 years and are classified as excellent in all aspects during that time.

Article 5

Officers and soldiers who have died are entitled to an order or decoration according to the provisions of articles 3 and 4 above.

Article 6

For martyrs who have died in battle or in work, the post-act shall be provided as follows:

a) Those who are eligible for the second-class order are awarded the first-class order.

b) Those who qualify for the third-class order shall be awarded the second-class orderl.

c) Those who are eligible for the decoration shall be awarded the third class order.

d) Those who have been in the army for 2 consecutive years or have served in the army for under 2 years but are classified as excellent in all aspects of their service are also entitled to receive a decoration.

Article 7

The award of a Order of the Soldier of Glory is decided by the National Assembly Standing Committee.

The awarding of the Decoration of the Soldier of Glory is decided by the Government Council.

Article 8

The Government Council details the implementation of this ordinance.

This Ordinance was passed on September 12, 1961 by the Standing Committee of the National Assembly of the Democratic Republic of Vietnam.
