LUẬT SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA LUẬT THI ĐUA, KHEN THƯỞNG CỦA QUỐC HỘI NƯỚC CỘNG HOÀ XÃ HỘI CHỦ NGHĨA VIỆT NAM SỐ 47/2005/QH11 NGÀY 14 THÁNG 6 NĂM 2005 Căn cứ vào Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung theo Nghị quyết số 51/2001/QH10 ngày 25 tháng 12 năm 2001 của Quốc hội khoá X, kỳ họp thứ 10; Luật này sửa đổi, bổ sung một số điều của Luật thi đua, khen thưởng đã được Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam thông qua ngày 26 tháng 11 năm 2003. Điều 1: Sửa đổi, bổ sung một số điều của Luật thi đua, khen thưởng: 1. Điều 58 được sửa đổi, bổ sung như sau: “Điều 58 1. Danh hiệu vinh dự nhà nước để tặng hoặc truy tặng cho cá nhân, tặng cho tập thể có những đóng góp đặc biệt xuất sắc vào sự nghiệp xây dựng và bảo vệ Tổ quốc. 2. Danh hiệu vinh dự nhà nước gồm: a) “Tỉnh Anh hùng”, “Thành phố Anh hùng”; b) “Bà mẹ Việt Nam Anh hùng” ; c) “Anh hùng Lực lượng vũ trang nhân dân”; đ) “Nhà giáo nhân dân”, “Nhà giáo ưu tú”; e) “Thầy thuốc nhân dân”, “Thầy thuốc ưu tú”; g) “Nghệ sĩ nhân dân”, “Nghệ sĩ ưu tú”; h) “Nghệ nhân nhân dân”, “Nghệ nhân ưu tú”.” 2. Bổ sung Điều 58a vào sau Điều 58 như sau: “Điều 58a Danh hiệu “Tỉnh Anh hùng”, “Thành phố Anh hùng” để tặng cho tỉnh, thành phố trực thuộc trung ương đạt các tiêu chuẩn sau: 1. Có thành tích đặc biệt xuất sắc và toàn diện trên các lĩnh vực chính trị, kinh tế, văn hoá, xã hội, giáo dục, khoa học, công nghệ, quốc phòng, an ninh và đối ngoại; đóng góp to lớn vào sự nghiệp đấu tranh giải phóng dân tộc, xây dựng và bảo vệ Tổ quốc; 2. Năng động, sáng tạo, xứng đáng là trung tâm kinh tế, văn hoá, khoa học, công nghệ, là động lực thúc đẩy sự phát triển của khu vực và cả nước trong công cuộc đổi mới, đẩy mạnh công nghiệp hoá, hiện đại hoá đất nước; 3. Tổ chức Đảng, chính quyền, Mặt trận Tổ quốc Việt Nam và các đoàn thể đoàn kết, trong sạch, vững mạnh; 4. Đã được tặng thưởng danh hiệu “Anh hùng Lực lượng vũ trang nhân dân” và danh hiệu “Anh hùng Lao động”.” Điều 2: Chính phủ quy định chi tiết và hướng dẫn thi hành Luật này. Luật này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XI, kỳ họp thứ 7 thông qua ngày 14 tháng 6 năm 2005.

LAW AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE LAW ON EMULATION AND COMMENDATION Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001, of the Xth National Assembly, the 10th session, This Law amends and supplements a number of articles of the Law on Emulation and Commendation, which was passed on November 26, 2003, by the National Assembly of the Socialist Republic of Vietnam. Article 1.- To amend and supplement a number of articles of the Law on Emulation and Commendation as follows: 1. Article 58 is amended and supplemented as follows: "Article 58.- 1. State honorable titles shall be conferred or posthumously conferred on individuals and conferred on collectives that have made exceptionally outstanding contributions to the cause of national construction and defense. 2. State honorable titles include: a/ "Heroic Province", "Heroic City"; b/ "Vietnamese Heroic Mother"; c/ "People's Armed Forces Hero"; d/ "Labor Hero"; e/ "People's Teacher", "Teacher of Merit"; f/ "People's Doctor", "Doctor of Merit"; g/ "People's Artist", "Artist of Merit"; h/ "People's Artisan", "Artisan of Merit". 2. To add Article 58a after Article 58 as follows: "Article 58a.- The "Heroic Province" or "Heroic City" title shall be awarded to provinces or centrally-run cities that satisfy the following criteria: 1. Having recorded exceptionally outstanding and comprehensive achievements in political, economic, cultural, social, education, scientific, technological, defense, security and foreign-relations domains; having made great contributions to the cause of the struggle for national liberation as well as national construction and defense; 2. Being dynamic and creative, and deserving to be an economic, cultural, scientific and technological center, serving as a motive to promote local and national development in the cause of renewal and accelerated national industrialization and modernization; 3. Having united, clean and strong Party organizations, administrations, Vietnam Fatherland Front committees and mass organizations; 4. Having been conferred the "People's Armed Forces Hero" and "Labor Hero" titles." Article 2.- The Government shall detail and guide the implementation of this Law. This Law was passed on June 14, 2005, by the XIth National Assembly of the Socialist Republic of Vietnam, at its 7th session.
